A pregnant woman accused of fatally shooting another Uber passenger last year claimed that her unborn child is innocent of all wrongdoing and should be allowed to leave prison. When 28-year-old Gladys Yvette Borcela was shot in the stomach and died in Florida in July of last year, Natalia Harrell was six weeks pregnant.

According to a video released this month, she was out partying in Miami and spent some time at a pub with several men. Two men and two women got into an Uber rideshare. The two men left got out and then the women got into a fight while they were travelling from South Beach to the city’s Brickell neighborhood. Harrell pulled out a gun and shot Borcela dead.
Reports said that Harrell’s attorney William Norris said in a new emergency petition that holding his client’s unborn child at Turner Guilford Knight Correctional Facility is a breach of the rights provided by both the Florida and U.S. constitutions.
Norris, who is also the unborn kid’s representative, declared that the “unborn child is a person” with constitutional rights. Additionally, the complaint filed by Harrell claims that because she was detained without a bond, the fetus has not received the required prenatal care.

Harrell also claimed that the unborn child has also been a victim of carelessness, according to documents obtained by the Miami Herald, including one incident when Harrell was transferred to a vehicle at temperatures above 100 degrees. She also reportedly said that the baby had the right to be free from ‘unlawful and illegal detention’ and deserved not to be born in a prison.
According to a police report from Law & Crime, the tragic shooting that occurred last summer was caused by a fight that broke out inside a crowded Uber. Soon after they all crammed into their Uber, tensions turned tragically violent.
