A federal judge in Florida fined former president Donald Trump and one of his attorneys about $1 million late on Thursday for filing a baseless lawsuit against Hillary Clinton, his Democratic opponent.
Trump and his attorney also attempted to blame Clinton for his Twitter ban, claiming that he was barred due to a “misinformation campaign.” However, Middlebrook pointed out that despite Twitter’s determination that Trump’s remarks created “the potential of additional incitement of violence,” Trump’s Twitter account was not suspended until January 8, 2021, two days after the January 6 attack on the U.S. Capitol.
The complaint, which was filed more than five years after their contest in the 2016 presidential election, said that Clinton, the DNC, and other parties “maliciously conspired to create a false narrative” that Trump had aided Russia in the contest. To do this, it was said that they “falsified evidence, misled law enforcement, and exploited access to highly sensitive data sources.”
Trump’s accusations, however, were deemed “totally ridiculous, both factually and legally,” by the judge. “This case should never have been brought. Its inadequacy as a legal claim was evident from the start. No reasonable lawyer would have filed it. Intended for a political purpose, none of the counts of the amended complaint stated a cognizable legal claim.”
Middlebrook claimed that these filings comprised several claims against numerous defendants without identifying which defendants were allegedly liable for each act. They also featured “conclusory, imprecise, and immaterial facts not obviously tied to any particular cause of action.”
In their case, Trump, Habba, and the Habba Madaio & Associates legal firm allegedly engaged in “abusive litigation tactics” that included submitting three types of shotgun pleadings that were disapproved by the 11th Circuit.
