Convicted Theranos ex founder Elizabeth Holmes legal team tries to delay prison entry after birth of second child. According to new court documents Elizabeth Holmes, who was convicted after causing a criminal scam with Theranos, a company she founded, has two children. It also suggests that although she is romantically involved with Billy Evans, the father of her children, she may not be legally married to him. Her lawyers have filed documents to delay the start of her 11-year prison term.

Elizabeth Holmes had her first son, in July 2021, when she was waiting for a trial after she was charged with fraud. Her now defunct blood-testing startup in Palo Alto called Theranos was charged with defrauding both high profile investors as well as patients.

Holmes was convicted in January 2022, and ten months later she was sentenced to over 11 years in prison. She became pregnant for the second time, in the interim period between her conviction and her sentencing.

Judge Edward Davila delayed her prison incarceration until April 27, so that Elizabeth Holmes could deliver her child outside prison. There is no information available on when the second child was born but it is being speculated that the baby would have been born in December or January, as she was in the late stages of pregnancy, when she appeared in court in November last year.

According to Mercury News, court papers filed on Thursday, reveal that she is now the mother of “two young children.” Although fiancé Billy Evans has been called the father of both the children, there is allegedly no clear mention of him as her husband. Instead, he is reportedly mentioned as her fiancé. This has led to speculation that Elizabeth Holmes and Billy Evans might not be legally married.

In January 2023, prosecutors said that Elizabeth Holmes was a flight risk. They claimed that she was trying to flee the U.S. to Mexico with a one-way ticket, after she was convicted.

The court filing on Thursday by Holmes’ legal team once again reiterated that their convicted client had not planned to flee from the U.S. to Mexico. However, they did not mention why there was no return ticket booked for their client.

As of now, Elizabeth Holmes is scheduled to start her prison term on April 27, 2023. Her lawyers are trying to have the sentence put off, and they are filing an appeal on her behalf.
