Minnesota Mall Settles Lawsuit over Boy Thrown from Third Floor Balcony

The family of a boy who was thrown over a balcony almost three years ago at the Mall of America in Minnesota has finally reached a settlement with the mall, the family’s attorneys stated.

According to a criminal complaint, the 5-year-old, publicly revealed only as Landen, was standing beside his mother outside the Rain Forest Café on April 12, 2019. A man suddenly approached the pair, picked up the boy, and threw down over the railing.

Landen plummeted approximately 40 feet to the first level. According to his family, he suffered extensive injuries that put him in critical condition and necessitated months of hospitalization, several surgeries, and extensive physical rehabilitation therapy.

The attacker was 28-year-old Emmanuel Aranda, who admitted to throwing the child and pleaded guilty to attempted first-degree murder in the attack in 2019. He received a 19-year prison sentence. Aranda told police that he came to the mall the day before intending to kill an adult, but that plan did not “work out,” so he returned the next day and attacked the boy instead.

Last year, the child’s family sued the Mall of America, accusing it of negligence and seeking damages for medical expenses, future medical expenses, pain and suffering, future income loss, and mental anguish and distress. According to the lawsuit, Landen’s medical bills totaled more than $1.75 million.

According to a statement from the family’s attorneys, Briol & Benson, PLLC, the family and the mall reached a “confidential settlement” of the suit, and the two parties agreed to make changes to the mall’s trespass policies to limit the entrance of “violent criminals.” The family requested that any policy changes be named after the child.

The attorneys said that the boy’s recovery has been miraculous. The focus now would be on his health, wellbeing, and privacy. His family said that Landen happily returned to school with his twin brother and sister after being released from the hospital in 2019.

The family posted on their GoFundMe account that he was happy and getting stronger. They said that he is happy and gets out of the car blowing kisses while walking to the house. He reassures his mom that he is healed.
