Supreme Court to hear cases that could change the internet

The Supreme Court has intervened to attempt to reduce internet regulation. Legislators on both sides of the political spectrum have been concerned for years by the proliferation of harmful content online. The Supreme Court will take up the cases on Tuesday, which has the potential to change how online regulations are formulated and even the nature of the internet.

The larger internet is significantly at stake in the two hotly debated cases, Gonzalez v. Google and Twitter v. Taamneh. Major changes could be made to websites like Facebook, TikTok, Instagram,  Wikipedia, and YouTube, to mention a few, as a result of an increase in the legal risk that apps and websites run when hosting or promoting content.

The Communications Decency Act’s Section 230, which was created by Congress in 1996 to shield internet service providers from responsibility for content that third parties publish on their platforms, will be the subject of a Supreme Court case called Gonzales v. Google. The justices will evaluate algorithmic recommendations that internet corporations claim is crucial, rather than focusing on content-moderation rules that have received most of the criticism for Section 230.

The Communications Decency Act’s Section 230, a 30-year-old federal law that courts have repeatedly stated offers broad protections to tech platforms.    There has been much scrutiny along with the mounting criticism of Big Tech’s content moderation decisions, which stands at the center of the legal dispute.

Both political parties have criticized the measure. Some Republican politicians assert that Section 230 permits social media sites to suppress content that supports conservative stances. President Joseph Biden and other prominent Democrats have warned that Section 230 shields tech firms from liability for disseminating false material and hate speech.
