The FTC will challenge the court’s judgment that the Microsoft-Activision merger won’t harm competition. Friday at midnight, Judge Corley’s order to halt the transaction expires.

Regulators in the UK are still against the merger, but Microsoft and Activision are considering changing the conditions of their merger to allay their concerns.

The deadline for the merger proposal is July 18.

The decision was a defeat for FTC Chairwoman Lina Khan, who had aimed to be more aggressive in her opposition to corporate mergers in the IT sector and other sectors. Thursday’s oversight meeting before the House Judiciary Committee will feature her testimony.

Earlier on July 11, a federal judge dismissed the FTC’s attempt to halt Microsoft’s acquisition of Activision, finding that the government had failed to establish that the deal would materially diminish competition.

“The FTC has not shown it is likely to succeed on its assertion that the combined firm will probably pull Call of Duty from Sony PlayStation, or that its ownership of Activision content will substantially lessen competition in the video game library subscription and cloud gaming markets,” the FTC stated.
