After a protracted hearing in federal court in Washington, D.C., involving a request from Smith and his team to restrict what Trump can say about the case brought against him by the Justice Department, U.S. District Judge Tanya Chutkan made her judgment

The federal judge presiding over the case against former President Donald Trump involving the 2020 election decided Monday to place some restrictions on what he can say publicly about the case, prohibiting the former leader and his lawyers from making incendiary remarks about special counsel Jack Smith, his staff, court personnel, and potential witnesses who may be called as witnesses in the proceedings.

Alarm had been raised by the special counsel Jack Smith’s team regarding a flurry of comments criticizing the judge, prosecutors, and potential witnesses. Prosecutors claimed that those remarks ran the risk of eroding public trust in the legal system and harassing and intimidating witnesses and potential jurors.

No restrictions, according to Chukan, would be placed on criticism of the Justice Department as a whole or of Trump’s assertion that the case is politically motivated.

Trump’s legal team vehemently resisted any gag order, contending that it would impair his freedom of speech. The 2024 GOP presidential front-runner is accused by Smith’s team of employing online attacks to try to damage public trust in the legal system and taint the jury pool in their request for a gag order.

John Lauro, the attorney for Trump, charged that the prosecution was “trying to censor a political candidate in the middle of a campaign.” The judge, however, retaliated by saying that Trump “does not have a right to say and do exactly as he please.”

“You continue to discuss censorship as though the defendant’s First Amendment rights are unrestricted. He doesn’t,” stated Chutkan. “Censorship is not the topic at hand. We’re talking about limitations to make sure justice is administered fairly in this situation.
