A Florida paraprofessional-teacher, who was severely beaten by an autistic student, is not lying low and has asked for stringent punishment for the 270-pound autistic student who beat her. She was rendered unconscious by the beating and is not accepting a defense plea that wants her to help lighten his sentence, according to reports. Both the attorneys for Depa and Naydich will get a chance to place their case before a judge.

Brendan Depa, a former student of Matanzas High School faced a first-degree felony charge after a video of him beating a paraprofessional went viral. His attorney Kurt Teifke said that the 18-year-old, who was 17 years old during the incident, will plead guilty, to avoid a trial. He has asked for a plea hearing on October 30, and a sentence hearing that will be scheduled later, according to the site FlaglerLive.

The report also says that there is no plea agreement between the two parties and that Depa will enter an open plea. This means that Circuit Judge Terence Perkins can decide his penalty. He can face a wide sentence ranging from probation to up to 30 years in prison. The judge can also decide whether he would be charged as a juvenile or as an adult.

The severe beating took place after Depa reportedly followed Joan Naydich and pummeled her till she reportedly became unconscious, as per the video whose recording does not have sound. School staffers pull him off her. Naydich was hospitalized and released. She has shown no inclination to mitigate the penalties that Depa might face.

Earlier that day there had been a conflict with Depa’s allowance to use an electronic game, (reportedly on a Nintendo Switch) at a certain point of time. Towards the end of the class, Depa had been ordered not to use the game. Staffers discussed the issue in front of him. This made him angry and he followed the paraprofessional Naydich out of the classroom and into a hallway, where the beating took place.

There are questions whether the school staff handled the matter appropriately, initially. Depa’s mother had previously suggested that the matter could have been handled in a better way.
